Booking a flat means putting your life in danger

The day I took possession of my flat at Kalpataru Estate, I realized that I had made a big mistake. Believing in the name "Kalpataru Ltd." and paying too much for their poor construction quality.

But after the death of Sahil,, 13 month old baby, I realized that - believing in the name "Kalpataru Ltd. (www.kalpataru.com)" was - not only a financial mistake. But by buying a flat at Kalpataru Estate, I have put my family's life in danger.

This is not only my view. All residents of Phase 1, Phase 2 & Phase 3 of Kalpataru Estate Pimple Gurav are sure that our life is in danger.


So, we, the residents of Kalpataru Estate, demand safety of our life.

We, the residents of Kalpataru Estate, want safe water.
We, the residents of Kalpataru Estate, want safe lifts.
We, the residents of Kalpataru Estate, want safe electricity.
We, the residents of Kalpataru Estate, want safe waste management.
We, the residents of Kalpataru Estate, want safe security system.
We, the residents of Kalpataru Estate, want working fire fighting system.

As an assurance, we, the residents of Kalpataru Estate, have told Kalpataru Ltd. to deposit one lakh rupees per flat with us.

If Kalpataru Ltd. fails to fulfil its promises, in the agreed time frame, the total deposit will be confiscated.

Rohit, resident of Kalpataru Estate Pimple Gurav, was telling me about the plan of action of the residents.

After the unfortunate incident of last Friday, 12th October 2012, Rohit had invited me for a cup of tea.

We were meeting for the first time. He came to collect me at the main gate of Kalpataru Estate Pimple Gurav. Showed me the place where Sahil, 13 month baby, died because of the electrocution.

Described how all residents collectively interrogated, debated, discussed, & negotiated with the management of Kalpataru.

After hearing for a while, I said, "I was expecting you to be very angry. But you are too calm & composed!"

I will tell you why," Rohit said and started describing how all residents of Kalpataru Estate were suffering for more than a year.

For a long time, after the possession, I was very frustrated. I means we all - were very frustrated with Kalpataru. Over a year, after collecting huge amounts of maintenance charges, Kalpataru was completely neglecting us. Not paying any attention to issues we were facing. Small & big issues about repairs & maintenance. About leakage & seepage, damp walls, defective flooring, poor water quality, defective electrical switches, not providing piped gas, garbage shoot not working, irrational telephone charges, thefts, steam bath not working, delay in society formation etc. Including the 2 complaints of electrical shock in the landscaped garden.

But the death of a baby turned our frustration - helplessness - into deep sorrow. Left us no option to be angry with the builder. Or with ourselves. Now, we all are determined to correct the things. Not to suffer anymore. Not to lose one more life. So, we are all focusing on safety. Safety of our life. From Kalpataru.

"I was not expecting this from Kalpataru. I have visited many Kalpataru projects in Mumbai. - You know what? - I was so confident about this builder - I was recommending every Kalpataru project - Kalpataru Harmony & Kalpataru Splendour at Wakad, Kalpataru Serenity at Manjri to all my readers," I said.

"Big mistake! Correct it Ravi Karandeekar - immediately," Rohit said.

"How?," I asked.

"I will tell you how - from my experience of Kalpataru!," Rohit said and added that first those who have already booked in any Kalpataru project should accept that Kalpataru is as good as any Tom, Dick & Harry - local builder.

Those who have booked flats in Kalpataru have to come together and form a group. Start conducting regular meetings. Recording minutes of the meeting. Supervising & questioning Kalpataru at every step. Including demanding third party audit of their construction at every step. Like, now, we are demanding third party audit of the safety in Kalpataru Estate.

In fact, this is applicable to any project - any builder. There is less difference between a small builder and a Big - Branded Builder. Big builder means the one who can tell you a big lie. Big ads. Big showoff. Big property prices. Than the small one. Big or small - ultimately - the same contractors - same workers - same issues - same harassment. Only difference would be the material. Italian marble vs. Chinese tiles.

You know what? I Googled after this incident and found out that this is the second death in 2012. The first one was at Marvel Diva at Hadapsar. Before that - in 2005 - 3 died in Goel Ganga Group's 'Ganga Teerth at Sahakar Nagar'. A balcony fell down at Nyati Meadows in Kalayni Nagar.

After reading this I wonder why we believe in any builder's colorful ads? Why we visit property exhibitions? These builders only know how to make us pay in advance. These builders are experts in tempting us to pay. These builders don't know how to construct well. So, let them prove - construct - and then - if you like - buy his property.

If you have already booked - being assertive is essential. Builders have powers - politicians & police force - in their pocket. So, you can't be aggressive. It won't work. But you can be assertive - because this industry works on your money.

"Sounds practical - I can suggest this & hope that those who have booked in other Kalpataru project don't suffer like you!," I said.

"That's next to impossible - but you can try!," Rohit said.

"In that case, what is the better way?," I asked.

"The one you have started recommending recently," Rohit said.

"Which one? Stop booking - start buying ready possession flats?," I asked.

"Yes!," Rohit said and asked me,"You know Murphy's Law? - Anything that can go wrong will go wrong - 'booking a flat' is a wrong way to buy a home - which will always go against you!," Rohit said.

What about you? When you book a flat - do you ever realize that you are putting your family's life in danger?

    Instead of business mind - Please come forward with human responsibility. we want Construction quality / Deadlines / work progress audit every 3 months and report should be sent to all flat owners as soft copy.

If you are an investor with goal to invest for capital appreciation, stop Investing a single rupee in Pune real estate.Spread the word, break the builder politician nexus.Right now they have no competiion so they have taken us IT people granted. Down the line 3 years, the IT industry/Bank captives will migrate to Gujarat, following the clues from current shift of Manufacturing, Auto and FMCG heavy weights, the real estate in Pune will crash like a palace built of cards. Everywhere one can observe the desperateness of Pune builders to sell off and vanish.Government has failed in providing rightful intrastructure/flyover for Hinjewadi.Corporates are evaluating options and companies are shifting all together outside Maharashtra.Before booking next flat, do the ground level checks, do not go by builders' words. There was a time 5 years back to invest in Pune and make money. If you want to invest now, Invest at a place where it can treble in next 5 years.Catch the trend

Once the GIFT SEZ gets completed, most of the domestic and MNC bank data centres/captives, supposedly high paying companies, which are facing space constraints in Mumbai will move to GIFT.Pune buyer need to understand that buy only for self use. Do not buy based on what builder is selling ie. xyz company will come near our project, etc etc. Do not buy for speculation else you would repent.

  5. Very sad to read this blog. The lust for money has ruined humanity. Even in any single small project Builders earn crores of rupees. But their unending hunger for money keeps them moving to cheat innocent buyers. Why don't they deliver appropriately, when they take money from customers.

    Almost all builders are same. Their evil minds are programmed to always eat, eat and eat money as much as possible- Like an wild animal indulges into flesh eating aggressively.

      I am resident of Kalpataru Estate. They send us letter demanding VAT at 2.83% of agreement cost. We received it on 19th of Oct. and it says last date for payment will be 20th Oct. How rubbish. Its too much.

    2. Pallavi...Together you all unite and fight against builder. Builder is not a giant demon - has no any great power. Builder is same human being having two legs, two hands. Though he may appear strong due to money power, he also has fear in life like any ordinary person. It's a bit difficult to fight with builder as an individual, but you can certainly pressurize him as a group. Let him realize the power of unity. He has to bend down at certain point of time. You have to persistently chase him till you get justice.

This is horrifying , This is really bad what is happening out here, who has given them occupation certificate, does anybody check that before they moved in , These builder should have impose a criminal offence and screw them in Jail till other builders takes a lesson from them , I don’t think they are anything less than a mafiya these days , atleast a we know mafiya and beware of them but these builder which are white coller mafiya should be fire at once,
    Don’t take in wrong way but when I think of my little daughter and just a thought of this gives me gooesbumps , I mean come on guys money is not everything , this is LIFE and you can’t play with that , I can’t think of parent of that kid must have gone through…
    I think Municipal corporation should learn their lesson on this incident and should not give any occupation certificated before check for all security measure and occupies should not go ahead without these…

    NOW THIS IS ENOUGH , WE SHOULD HAVE STRICT STRICT AND VERY STRICT “LAWS” TO DEAL WITH THESE BUILDERS AND MUNICPAL COMMISSION TOO…

  8. I think Govt. Authority should devise a mechanism wherein builder can only sell his product when it is ready-to-move-in. Ofcourse with all legal things taken care of. Do we buy refrigerator, TV, Car or motorcycle at pre-launch, launch or under construction (manufacturing stage)?. Then why to buy a house which is merely a concept on paper with all ambiguities and risks involved in it?....Are we so casual (rather helpless)to buy this concept which is 100 times costlier than TV or refrigerator ???

    Secondly there should be a price regulator. This is high time and Govt. should seriously think over it. Price can be evaluated in terms locality, road access, and other important factors/criteria. Once a price is fixed for a particular area zone by Govt. appointed experts committee, builder should stick to that price. No bank will sanction loan if builder does not stick to this price as recommended by Price Regulatory Committee...No any concept of builder reputation, high-class amenities, early bird discount, pre-launch offer, which is nothing but an illusion created by builders.

Hi Ravi!!! i dont agree to the notion that"don't buy flats in booking rather buy ready possession!! if this is the case then u should be buying flats in any project after two years of completion and not ready possession bcoz all the buildings and all the builders are similar for first six months!!! the difference is visible only after six months..for me, complaints like seepage, leakage are very common but attending them immediately is a symbol of a good builder!! and, yes, participation of flat holders in the progress and maintenance is very essential..i don't boast but in our projects all the flat holders have formed a online google group to share their experiences and feedback with us and this way transparency and accountability on the part of builder increases...i think just accusing the entire fraternity of builders has become fashion but i will blame the flat holders too..its a two way thing..

      Are you a builder or work for builder?
      Why are you blaming flat owners? They pay hard earned money by putting whole life time savings at risk and look at what service they get from builder community. Why can not builders built flats with exceptional quality so that owners don't have to complain at all. I think that is fair to expect from builders.
